IMUK Solutions Ltd. Terms of Service for IMHub and IMHub Community

Welcome to IMUK's IMHub and IMHub Community!

These Terms of Service ("Terms") govern your access to and use of the IMUK website and its features, including IMHub and IMHub Community (collectively, the "Service"). IMHub and IMHub Community are dedicated to fostering a neuroinclusive environment where individuals of all backgrounds can connect, share, and collaborate. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you are not authorised to use the Service.

1. IMUK Membership

1.1. Membership Overview: IMUK offers a membership programme that provides access to exclusive benefits and resources within IMHub and IMHub Community, with a focus on promoting neuroinclusion and supporting neuroinclusive practices.

1.2. Commitment: Membership is a 12-month commitment, and you can choose to pay for the full year upfront or in monthly instalments.

1.3. Founding Members: Founding members receive a 20% discount on membership fees for the first year only. After the first year, the membership fee will revert to the full price.

2. Cancellation and Refunds

2.1. Refund Policy: Due to the nature of the year-long commitment, IMUK generally does not offer refunds on memberships.

2.2. Exceptions: Exceptions to the refund policy may be made in cases of gross misconduct by IMUK or in other extenuating circumstances.

2.3. Requesting a Refund: If you believe you are eligible for a refund, please contact IMUK at [email protected]

3. Payment

3.1 Payment Terms: Members are required to pay for their membership at the time of purchase, followed by monthly payments on the same date each month for those who opt for instalments. Payment for your membership is due upon signup for the full year option or as scheduled for the instalment option.

3.2 Payment Processing: In the event that we are unable to process your membership payment successfully, our system will automatically retry the payment every three days using the existing payment method provided. We reserve the right to manually attempt payment at any time using your existing payment method or any new payment methods that you may add to your account to settle any outstanding balances.

3.3 Termination for Non-Payment: IMUK reserves the right to terminate your membership and remove access to the Service if your payment fails and we are unable to contact you to rectify the issue. IMUK is not liable for any late payment fees or charges related to failed payments. It is your responsibility to ensure that your payment information is accurate and up-to-date to avoid disruptions in service.

3.4 Cancellation of Membership: Should you wish to cancel your membership, it is your responsibility to cancel any recurring payment arrangements directly. IMUK does not accept payment in the form of cheques. Consequently, all purchases and agreements will cease with immediate effect until all outstanding amounts are recovered in full.

4. Access to IMHub and IMHub Community

4.1. Participation: Participation in IMHub and IMHub Community is optional, regardless of your membership status.

4.2. Platform Description:

IMHub:
IMHub is an educational platform that offers webinars, resources, and various ad-hoc events, such as Q&A panels, focused on neuroinclusion. These resources are designed to support organisations on their journey to becoming more neuroinclusive.
IMHub Community:
The IMHub Community serves as a space where members can connect with one another, share best practices, and ask organisation-specific questions. It functions much like the first-ever B2B Employee Resource Group.

4.3. Content Moderation: IMUK does not moderate the content posted to IMHub or IMHub Community and is not responsible for any communication or disputes that arise between members. IMUK encourages members to use these platforms respectfully and constructively.

4.4. Opt-Out: You may opt out of participating in IMHub and IMHub Community at any time. However, if you opt out, your name and profile information will no longer be viewable to other users. Any content you have created may remain visible to members, and your data may be retained and used by IMUK. You may request that any or all of this data be permanently deleted by submitting a request to [email protected]

4.5. Blocking Users: You can block any individual user from contacting you by selecting the "Block" option on their profile.

5. User Content

5.1. Responsibility for Content: You are responsible for all content you post, upload, share, store, or otherwise provide through IMHub and IMHub Community ("User Content").

5.2. Rights and Permissions: You represent and warrant that you have all rights necessary to contribute your User Content in the manner in which you contribute it, including the necessary permissions or licences to use any third-party content or materials in your User Content.

5.3. Prohibited Content: You agree not to contribute any User Content that:

Infringes or violates the intellectual property rights or any other rights of anyone else.
Violates any law or regulation.
Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
Jeopardises the security of your account or anyone else's account.
Spams other users or promotes unsolicited commercial messages.
Contains personal or confidential information about yourself or others.
Promotes or encourages illegal or harmful activities.
Is discriminatory or offensive based on protected characteristics, such as race, ethnicity, religion, gender, sexual orientation, age, disability, or neurodiversity.

5.4. Content Removal: IMUK reserves the right, in its sole discretion, to remove or disable any User Content that violates these Terms or that IMUK deems inappropriate. IMUK may also edit or modify User Content to remove or obscure any personally identifiable information or other sensitive data.

6. Licences

6.1. Licence to IMUK: By posting User Content to IMHub or IMHub Community, you grant IMUK a non-exclusive, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, publish, distribute, and translate your User Content for the purpose of operating and providing IMHub and IMHub Community.

6.2. Retention of Ownership: You retain ownership of your User Content, but you agree that IMUK and other users of IMHub and IMHub Community may access and use your User Content in accordance with these Terms and the functionality of IMHub and IMHub Community.

7. Third-Party Websites and Services

IMHub and IMHub Community may contain links to third-party websites and services. IMUK is not responsible for the content, accuracy, or privacy practices of any third-party websites or services. You are encouraged to be aware when you leave IMHub or IMHub Community and to read the terms and conditions and privacy policies of each third-party website or service that you visit.

8. Copyright Notice

Copyright and other relevant intellectual property rights exist on all text relating to the Company’s services and the full content of this website. This Company’s logo is a registered trademark of this Company in the United Kingdom and other countries. The brand names and specific services of this Company featured on this website are trademarked.

9. Disclaimer

9.1. Information Disclaimer: The information and content provided on IMHub and IMHub Community are for informational purposes only and should not be construed as professional advice. IMUK makes no representations or warranties about the accuracy, completeness, or timeliness of the content. You should always consult with a qualified professional before making any decisions based on the information provided on IMHub or IMHub Community.

9.2. Service Disclaimer: The Service is provided on an "as is" and "as available" basis. IMUK disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. IMUK does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

IMUK will not be liable for any damages arising out of or in connection with your use of the Service, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

11. Log Files

We use IP addresses to analyse trends, administer the site, track users' movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Additionally, for systems administration, detecting usage patterns, and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL.

This information is not shared with third parties and is used only within this Company on a need-to-know basis.

Any individually identifiable information related to this data will never be used in any way different from that stated above without your explicit permission.

12. Cookies

Cookies provide information regarding the computer used by a visitor. We may use cookies where appropriate to gather information about your computer to assist us in improving our website.

We may gather information about your general internet use by using the cookie.

Where used, these cookies are downloaded to your computer and stored on the computer’s hard drive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

These Terms constitute the entire agreement between you and IMUK with respect to your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.

16. Waiver

No waiver of any provision of these Terms by IMUK shall be deemed a further or continuing waiver of such provision or any other provision.

17. Changes to the Terms

IMUK reserves the right to update these Terms from time to time. We will notify you of any changes by posting the new Terms on the Service. Your continued use of the Service after the posting of the revised Terms means that you accept and agree to the changes. You are advised to periodically review these Terms for any changes.
